How to file a complaint if the employer refuses to pay gratuity?

Gratuity is a lump sum payment given by an employer to an employee as a token of appreciation for their service to the company.

It is a mandatory benefit under the Payment of Gratuity Act, 1972, which applies to all establishments employing ten or more persons.

However, in some cases, an employer may refuse to pay gratuity to an employee, which can cause a lot of inconvenience and financial hardship.

Understanding the rules and regulations:

The first step in filing a complaint against an employer for non-payment of gratuity is to understand the rules and regulations governing the payment of gratuity. As per the Payment of Gratuity Act, 1972, an employee who has completed five years of continuous service with an organisation is eligible to receive gratuity.

The amount of gratuity payable is calculated as 15 days of wages for each completed year of service or part thereof in excess of six months. There is a maximum gratuity amount of Rs 20 lakh that can be paid.

Attempt to resolve the issue amicably:

If your employer has refused to pay gratuity, the first step is to try and resolve the issue amicably. You can write a letter to your employer, stating that you are entitled to gratuity as per the Payment of Gratuity Act, 1972, and requesting them to release the payment.

You can also approach the human resources department or the accounts department of your organization and ask for their assistance in resolving the issue.

File a complaint with the controlling authority:

If your attempts to resolve the issue kindly do not yield any results, you can file a complaint with the controlling authority under the Payment of Gratuity Act, 1972. The controlling authority is an officer appointed by the government to deal with complaints related to gratuity.

You can complain online in the http://pgportal.gov.in and you can file the complaint within 90 days from the date on which the gratuity became payable. You will need to submit an application in Form I, along with supporting documents such as proof of employment, proof of the gratuity amounts due, and proof of the employer’s refusal to pay.

Approach the labor court:

If the controlling authority fails to resolve the issue, you can approach the labor court. The labor court is a judicial body that deals with disputes between employers and employees. You will need to file a complaint in the labor court and attend the hearing.

The court will hear both parties and give a verdict.

The video shared on Twitter by Graphite Czech has now gone viral on social media with several users sharing it massively. Even the video has invited interesting and hilarious comments from netizens.

Odisha STA in action mode against underage driving, several students fined

Several traffic violators across the State were slapped with hefty fines as the State Transport Authority (STA) began a week-long special crackdown on underage driving ahead of the zero fatality week.

According to sources, several minor students were fined Rs 25,000 during the special enforcement drive launched by the STA.

Taking to Twitter, STA wrote, “If caught, the parent or vehicle owner will be fined with Rs.25000 & a 3-year jail term while the registration of the vehicle will be cancelled. Minor will also not be eligible for applying for licence until he or she turns 25. #SayNoToUnderAgeDriving.”

“As per the government guidelines, we are observing Tuesday as zero tolerance day. The underage drivers without licence are in our focus. Stringent action will be taken against the violators,” said Bibhav Samantasinghara, Rourkela RTO.

“We are focusing more on the minors who are driving without license. The special crackdown is being carried out across Odisha. Cases against several violators have been registered,” said Lalmohan Sethi, additional commissioner of enforcement of STA.

“I would like to urge the parents not to give two wheelers to their children. We would be successful if we obey the rules. We don’t want to put anyone into trouble, our aim is to avoid untimely accidental deaths,” Sethi added.

Earlier yesterday, the STA had warned that the violators will be fined up to Rs 25,000 for underage driving. Besides, the vehicle will be seized and its registration will be cancelled.

Most importantly, a case will be lodged against the registered owner of the vehicle. As per the law, the violator can be awarded 3 years jail term.

Electricity Amendment Bill not to impact agriculture sector, says Power Minister

The Electricity (Amendment) Bill, 2022 covers amendments related to power sector and there is no amendment proposal related to agriculture sector, the Parliament was told on Tuesday.

Power Minister R.K. Singh gave the assurance in response to a question in Lok Sabha during Question Hour.

“Further, the provision of subsidy as in the present Act i.e. Electricity Act, 2003 is not proposed to be changed and the states can continue to give subsidy to farmers and other consumers as they are doing at present,” he said.

As per Electricity Act, 2003, the subsidy to specific categories of consumers including domestic and farmers is decided by state governments.

The proposed legislation is currently under consideration of the Parliamentary Standing Committee on Energy, which is headed by BJP MP Jagdambika Pal.

Last year during the Monsoon session, the Electricity (Amendment) Bill was referred to the Parliamentary Committee by the power minister, immediately after being introduced in Lok Sabha, amid protests by opposition that it encroached upon powers of states and allows privatisation of electricity on the lines of communication sector.
